What is the appeal deadline for Social security?

Most of the time, Social Security provides 60 days to file your appeal. For example, if they have denied your initial claim, your reconsideration claim, or if you were denied by the ALJ, you will have 60 days to appeal to the next level.

A late appeal will only be accepted for “good cause,” such as serious illness, a death in the family, or other good reasons for missing the deadline.

Sometimes, the appeal period can be less than 60 days. For example, if your case was remanded from federal court, you will only have 30 days to file an appeal to the Appeals Council. Even shorter, if Social Security is cutting off your disability, there are only 10 days to appeal AND request that they continue to pay your benefits during the appeal.
